Terms of Service

Effective May 20, 2026 · Last updated May 20, 2026

These Terms of Service (“Terms”) are a legal agreement between you and Cody Simons, an individual (“we”, “us”, “Rushmore”), governing your use of the Rushmore iOS app and any related services (the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Please also read our Privacy Policy, which is part of these Terms.

TL;DR

1. Who can use Rushmore

2. Your account

3. Your content (Rushmores, hot takes, profile)

You own what you create. The Rushmores you build, the hot takes you write, your display name, and your avatar emoji belong to you.

By posting a Rushmore to the public Trending feed, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that Rushmore within the Service so other users can see it, react to it, comment on it, and remix it. This license lasts as long as the Rushmore is public, and ends when you delete it (subject to caches and backups that expire within 30 days). We won't sell your content to third parties or use it for advertising.

You also grant other users a license to view, like, comment on, and create derivative “remix” Rushmores from your public Rushmore, all within the app. (That's the whole point of the Trending tab.)

You're solely responsible for the content you post. We don't pre-screen content but we can remove anything that violates these Terms.

4. Acceptable use

Don't use Rushmore to:

Violation of any of these may result in content removal, account suspension, or permanent account termination at our discretion.

5. Hot takes and rankings about public people

Rushmore is, by design, an app where users rank real public figures and write short opinions (“hot takes”) about them. Hot takes and rankings are the opinions of the user who posted them, not statements of fact, and not our opinions or endorsements.

If you believe a hot take or Rushmore about you (or someone you represent) is defamatory or otherwise unlawful, please email hello@rushmore.app with the specifics and we'll review it promptly.

6. Wikipedia portraits and third-party content

The portrait photos that appear in the app are fetched from Wikipedia, operated by the Wikimedia Foundation, and are subject to Wikipedia's content licenses (typically CC BY-SA or public domain). We don't own them. If you want to know the license of a specific portrait, look it up on Wikipedia.

If you choose to share a Rushmore image (via the Share button or Save to Photos), that image is a composite that includes Wikipedia-sourced portraits. Your use of that image is subject to whatever license applies to the underlying portrait — for personal social-media sharing this is generally fine; commercial use may require attribution or different rights.

7. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, email hello@rushmore.app with: (a) your contact information; (b) a description and URL of the content you claim infringes; (c) a statement, under penalty of perjury, that you're the rights holder or authorized to act for them; and (d) your signature (electronic is fine).

We'll remove infringing content promptly. Repeat infringers' accounts will be terminated.

8. Termination

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CODY SIMONS, OR ANY AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (typically zero, since the app is free), OR (B) USD $50.

Some jurisdictions don't allow the exclusion or limitation of certain damages — in those places, the above limits apply only to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Cody Simons and any affiliates from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your content, your use of the Service, or your violation of these Terms.

12. Apple-specific terms

You acknowledge and agree to the following with respect to the Apple App Store:

13. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service that isn't resolved informally will be brought in the state or federal courts located in California, and you and we consent to personal jurisdiction in those courts. (If you're a consumer in the EU/UK, this section doesn't override mandatory protections of the law of the country where you live.)

You and we both waive any right to a jury trial. Class-action and class-arbitration claims are not permitted; disputes must be brought in your or our individual capacity.

If any provision of these Terms is unenforceable, the rest stays in effect.

14. Changes to these Terms

If we change these Terms materially, we'll update the effective date above and surface the change in the app the next time you open it. Continued use after a change means you accept the new Terms.
